The exact repercussions depend on which regulation was violated, whether a high-risk AI system is involved, and whether the violation was intentional or negligent. The following sections answer the most important questions about AI compliance risks and show how your company can protect itself.<\/p>\n<h2>What penalties apply to violations of the EU AI Act?<\/h2>\n<p>Violations of the EU AI Act can be punished with fines of up to 35 million euros or 7 percent of global annual turnover, whichever is higher. This maximum penalty applies to particularly serious violations, such as the use of prohibited AI practices. For less serious violations, the regulation provides for graduated sanctions.<br \/>\nThe EU AI Act&#8217;s fine framework is structured according to risk levels:<\/p>\n<ul>\n<li><strong>Prohibited AI practices<\/strong> (e.g. manipulative systems, social scoring): up to 35 million euros or 7% of annual turnover<\/li>\n<li><strong>Violations involving high-risk AI systems<\/strong> (e.g. missing documentation, no human oversight): up to 15 million euros or 3% of annual turnover<\/li>\n<li><strong>False or misleading statements<\/strong> to authorities: up to 7.5 million euros or 1.5% of annual turnover<\/li>\n<\/ul>\n<p>In addition to direct fines under the AI Act, further legal consequences may arise in parallel. Under the Act Against Unfair Competition (UWG), competitors or associations can issue cease-and-desist letters that compel the signing of a penalty-backed injunction. In cases of intent or negligence, liability for damages under \u00a7 9 UWG also applies. Serious violations \u2014 such as misleading AI statements or disclosure of trade secrets \u2014 can even result in criminal consequences under \u00a7\u00a7 16 to 20 UWG, including fines or custodial sentences of up to five years.<br \/>\nThe German Civil Code (BGB) also plays a role: if an AI system delivers incorrect results, the operating company may be held liable for breach of duty under \u00a7 280 BGB. If the AI causes harm, tortious liability under \u00a7 823 BGB applies.<\/p>\n<h2>Who within a company is liable for AI compliance violations?<\/h2>\n<p>Liability for AI compliance violations rests primarily with the operating company, not the AI system&#8217;s manufacturer. Executives and those responsible can be held personally liable if they have failed to meet their duty of care. AI cannot bear independent legal responsibility.<br \/>\nGerman law follows a clear principle: the company bears responsibility for the use of AI systems. In concrete terms, this means:<\/p>\n<ul>\n<li><strong>Management and board members<\/strong> are liable for failing to establish a functioning AI compliance management system.<\/li>\n<li><strong>IT managers and project leads<\/strong> are liable if they operate high-risk AI systems without the required documentation or human oversight.<\/li>\n<li><strong>HR departments<\/strong> are liable if AI-supported personnel decisions violate the General Equal Treatment Act (AGG). The AGG protects employees from discrimination, including discrimination carried out by AI.<\/li>\n<\/ul>\n<p>Particularly sensitive is the use of AI systems that function as a black box. In machine learning, decisions are often not transparently traceable, which considerably aggravates the question of liability in the event of harm. Operators of high-risk AI systems are therefore required to implement human oversight mechanisms and to retain automated logs for at least six months. Anyone who neglects these obligations risks personal liability.<\/p>\n<h2>What happens after an AI compliance violation is discovered?<\/h2>\n<p>After an AI compliance violation is discovered, the company must act immediately: serious incidents must be reported to the competent national authorities, the affected systems may not be operated further under certain circumstances, and complete documentation of the incident must be ensured.<br \/>\nThe EU AI Act requires operators of high-risk AI systems to report serious suspected cases and incidents in accordance with Art. 73 AI Regulation. In parallel, a prohibition on use applies to the affected system until the incident has been investigated. Cooperation with the competent national authorities is not optional \u2014 it is a statutory obligation.<br \/>\nIn practice, a typical process following a violation unfolds in several phases:<\/p>\n<ol>\n<li><strong>Immediate measures:<\/strong> Identify the affected AI system, take it out of operation if necessary, and initiate internal escalation.<\/li>\n<li><strong>Documentation:<\/strong> Secure all log data and record the incident without gaps.<\/li>\n<li><strong>Reporting:<\/strong> Inform the authorities; for data protection-related incidents, additionally review the data protection impact assessment under Art. 35 GDPR.<\/li>\n<li><strong>Root cause analysis:<\/strong> Determine the technical and organisational causes of the violation.<\/li>\n<li><strong>Corrective measures:<\/strong> Adjust processes, systems, or policies to prevent a recurrence of the violation.<\/li>\n<\/ol>\n<p>Companies that have violated their obligation to inform affected individuals about automated decisions must subsequently notify those individuals and draw their attention to their right to an explanation of the decision-making process.<\/p>\n<h2>Which industries carry the highest AI compliance risk?<\/h2>\n<p>The highest AI compliance risk is carried by industries that use high-risk AI systems \u2014 that is, AI in safety-critical or fundamental-rights-relevant areas. These include in particular healthcare, financial services, human resources, law enforcement, and critical infrastructures such as energy and transport.<br \/>\nThe EU AI Act classifies AI systems in these areas as high-risk because erroneous or discriminatory decisions can directly affect human lives, fundamental rights, or societal stability. Concrete examples of particularly risk-prone applications:<\/p>\n<ul>\n<li><strong>Healthcare:<\/strong> AI-assisted diagnosis, medical devices with AI components<\/li>\n<li><strong>Human resources:<\/strong> Automated applicant screening, AI-based employee performance evaluation<\/li>\n<li><strong>Financial services:<\/strong> Creditworthiness assessment, automated investment decisions<\/li>\n<li><strong>Public administration:<\/strong> AI-assisted administrative decisions, biometric identification<\/li>\n<li><strong>Critical infrastructure:<\/strong> Energy, transport, water supply with AI-controlled management<\/li>\n<\/ul>\n<p>Companies in these sectors are additionally required under the BSIG and the CER Directive to implement comprehensive risk management and security measures. Information security law thus adds a further compliance layer to the AI-specific obligations under the EU AI Act.<\/p>\n<h2>How can companies proactively avoid AI compliance violations?<\/h2>\n<p>AI compliance violations can be proactively avoided by establishing a structured AI governance system that encompasses risk classification, internal policies, employee training, and continuous monitoring. A proactive approach is considerably more cost-effective than reactive crisis management following a violation.<br \/>\nThe most important preventive measures at a glance:<\/p>\n<ul>\n<li><strong>AI risk assessment:<\/strong> Systematically classify all AI systems in use according to the risk categories of the EU AI Act.<\/li>\n<li><strong>Internal AI policies:<\/strong> Define and communicate clear rules for the permissible use of AI tools within the company.<\/li>\n<li><strong>Ensure human oversight:<\/strong> Establish binding monitoring processes for high-risk AI systems.<\/li>\n<li><strong>Meet documentation obligations:<\/strong> Follow operating instructions, retain log data, and carry out data protection impact assessments.<\/li>\n<li><strong>Train employees:<\/strong> Build AI competence throughout the entire company so that everyone involved can recognise risks and act in compliance with the rules.<\/li>\n<li><strong>Involve the works council:<\/strong> When deploying AI in the workplace, take co-determination rights under the Works Constitution Act (BetrVG) into account at an early stage.<\/li>\n<\/ul>\n<p>Particularly important is the establishment of an <a href=\"https:\/\/www.mitsm.de\/beratung\/iso-42001-audit\/\">ISO 42001 audit<\/a> as the foundation for a certifiable AI management system.
