The following questions guide you step by step through all the essential aspects of a practical AI policy.<\/p>\n<h2>What must a company AI policy contain?<\/h2>\n<p>An AI policy must contain at minimum the objectives of AI use, permitted and prohibited use cases, responsibilities, data protection requirements, ethical principles, and procedures for exceptions and deviations. It serves as a binding framework for all activities related to artificial intelligence within the company.<\/p>\n<p>Specifically, a complete AI policy should cover the following core areas:<\/p>\n<ul>\n<li><strong>Scope:<\/strong> Which systems, departments, and processes are affected?<\/li>\n<li><strong>Permitted AI applications:<\/strong> Which tools and use scenarios are approved?<\/li>\n<li><strong>Data protection and information security:<\/strong> Which data may be entered into AI systems?<\/li>\n<li><strong>Ethical principles:<\/strong> How are discrimination, bias, and transparency addressed?<\/li>\n<li><strong>Human oversight:<\/strong> Which decisions may AI not make autonomously?<\/li>\n<li><strong>Handling deviations:<\/strong> How are violations reported and dealt with?<\/li>\n<li><strong>Training obligations:<\/strong> Who needs to be trained on the safe use of AI, and how?<\/li>\n<\/ul>\n<p>According to ISO 42001, the international standard for AI management systems, the AI policy must be appropriate to the organisation&#8217;s purpose, be documented, be communicated throughout the company, and be accessible to all relevant stakeholders. In addition, the standard recommends supplementing it with topic-specific sub-policies, for example on AI resources, impact assessments, or the development of proprietary AI systems. A well-structured <a href=\"https:\/\/www.mitsm.de\/beratung\/iso-42001-audit\/\">ISO 42001-compliant AI policy<\/a> therefore not only provides orientation but also creates a solid foundation for future certifications.<\/p>\n<h2>Which legal requirements influence an AI policy?<\/h2>\n<p>The most important legal requirements for an AI policy come from the EU AI Act, the GDPR, copyright law, employment law, and general liability law. Companies that operate high-risk AI systems are subject to particularly strict obligations.<\/p>\n<p>The EU AI Act classifies AI systems according to their risk potential. Operators of high-risk AI systems are subject to, among other things, the following obligations, which must be directly reflected in the AI policy:<\/p>\n<ul>\n<li>Implementation of human oversight mechanisms<\/li>\n<li>Continuous monitoring and reporting to providers<\/li>\n<li>Obligation to report serious incidents<\/li>\n<li>Six-month retention obligation for automated logs<\/li>\n<li>Obligation to inform affected individuals about automated decisions<\/li>\n<li>Data protection impact assessment pursuant to Art. 35 GDPR<\/li>\n<\/ul>\n<p>The regulation also applies beyond high-risk systems: AI systems that interact with natural persons must inform those persons that they are communicating with an AI system. Synthetic content such as AI-generated texts or deepfakes must be clearly labelled. Additional requirements arise from data protection law, copyright law in the use of generative AI, and employment law co-determination rights when AI systems monitor employees or make decisions about them.<\/p>\n<h2>How does an AI policy differ from a general IT policy?<\/h2>\n<p>An AI policy differs from a general IT policy in that it specifically addresses the risks, transparency requirements, and ethical implications of AI systems that conventional IT frameworks do not cover. While IT policies establish rules for the use of software and infrastructure, an AI policy also governs questions of decision-making autonomy, traceability, and social responsibility.<\/p>\n<p>Concrete differences emerge in several areas:<\/p>\n<ul>\n<li><strong>Decision-making responsibility:<\/strong> AI systems can independently generate recommendations or decisions. The leadership level must actively adopt and communicate the AI policy, while the AI officer ensures operational implementation and compliance.<\/p>\n<p>According to ISO 42001, senior management must define the AI policy and associated objectives, align them with the organisational strategy, and ensure they are achieved. In concrete terms, this means:<\/p>\n<ul>\n<li>The executive management bears formal responsibility and signs off on the policy.<\/li>\n<li>An AI officer coordinates the creation, monitors compliance, and reports to management.<\/li>\n<li>Legal and data protection departments verify conformity with the EU AI Act and GDPR.<\/li>\n<li>HR and the works council are involved when AI systems affect employees.<\/li>\n<li>IT and specialist departments provide an overview of AI systems in use and planned.<\/li>\n<\/ul>\n<p>In smaller companies without a dedicated AI function, the IT manager or the data protection officer frequently takes on the coordination role.
