Since it came into force in August 2024, it has placed new obligations on companies across the EU. If you develop, operate, or use AI systems, you should know what duties apply and what consequences non-compliance can bring.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is the EU AI Act and who does it affect?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The EU AI Act classifies and regulates AI systems according to their risk potential. It applies to all companies that develop, distribute, or use AI systems in the EU, regardless of where the company is based.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The regulation distinguishes four risk levels: unacceptable risk, high risk, limited risk, and minimal risk. AI systems with unacceptable risk \u2014 such as social scoring or manipulative AI \u2014 are completely prohibited. High-risk AI in areas such as medicine, education, personnel decisions, or critical infrastructure is subject to strict requirements regarding transparency, documentation, and human oversight.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Which violations lead to penalties under the EU AI Act?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Penalties apply in three main cases: the use of prohibited AI practices, the breach of obligations for high-risk AI, and the submission of false information to authorities.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n <li>Missing risk management systems and technical documentation<\/li>\n <li>Insufficient transparency towards users<\/li>\n <li>Inadequate human oversight of automated decisions<\/li>\n <li>Missing conformity assessments prior to market launch<\/li>\n <li>No registration in the EU database for high-risk AI<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How high are the fines for non-compliance with the EU AI Act?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n <li><strong>Violations of prohibited AI practices:<\/strong> up to \u20ac35 million or 7% of global annual turnover<\/li>\n <li><strong>Breach of obligations for high-risk AI:<\/strong> up to \u20ac15 million or 3% of global annual turnover<\/li>\n <li><strong>False or misleading statements to authorities:<\/strong> up to \u20ac7.5 million or 1.5% of global annual turnover<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">More proportionate caps apply to SMEs and start-ups. The sanctions are comparable to fines under the GDPR and underline the political seriousness of this regulation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who is responsible for enforcing the EU AI Act?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Enforcement operates on two levels: each EU member state designates national market surveillance authorities; at the European level, the <strong>AI Office<\/strong> of the European Commission coordinates uniform application. In Germany, responsibility is still being clarified \u2014 the Bundesnetzagentur or BSI are under discussion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How can you ensure EU AI Act compliance?<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n <li><strong>Create an AI inventory:<\/strong> Record and document all AI systems in your company<\/li>\n <li><strong>Carry out risk classification:<\/strong> Assign each system to the correct risk category<\/li>\n <li><strong>Derive obligations:<\/strong> Build technical documentation, a risk management system, and a conformity assessment for high-risk AI<\/li>\n <li><strong>Implement transparency obligations:<\/strong> Clearly inform users about AI interactions<\/li>\n <li><strong>Establish internal governance:<\/strong> Define responsibilities, processes, and controls<\/li>\n <li><strong>Train your employees:<\/strong> Qualify relevant teams on the requirements of the EU AI Act<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">One important building block is <a href=\"https:\/\/www.mitsm.de\/schulung\/ki-kompetenz\/\">AI literacy training<\/a>: the EU AI Act explicitly requires that employees working with AI systems have sufficient AI knowledge (&#8222;AI Literacy&#8220;) \u2014 for both technical and non-technical professionals.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What deadlines and transitional provisions apply to the EU AI Act?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n <li><strong>August 2024:<\/strong> The regulation enters into force<\/li>\n <li><strong>February 2025:<\/strong> Prohibitions on unacceptable AI practices take effect<\/li>\n <li><strong>August 2025:<\/strong> Requirements for General Purpose AI (GPAI) apply<\/li>\n <li><strong>August 2026:<\/strong> Full application for high-risk AI systems<\/li>\n <li><strong>2027:<\/strong> Transitional periods for existing high-risk systems expire<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Companies should act now: implementing compliance measures for high-risk AI requires considerable preparation, and underestimating deadlines risks time pressure and mistakes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How we support you in achieving EU AI Act compliance<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">mITSM helps companies understand and implement the requirements of the EU AI Act.
