Both come from Brussels, both affect companies in the EU, and both protect fundamental rights. Yet they work very differently \u2014 confusing them risks creating blind spots in your compliance strategy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is the EU AI Act and what does it regulate?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The EU AI Act is the world&#8217;s first comprehensive legal regulation for artificial intelligence. It defines which AI systems may be used in the EU and what requirements providers and operators must meet. The law came into force in 2024 and will be fully applied in stages by 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The core of the regulation is a risk-based approach with four categories:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n <li><strong>Unacceptable risk:<\/strong> Prohibited applications, e.g. state scoring systems<\/li>\n <li><strong>High risk:<\/strong> Systems in areas such as healthcare, education or law enforcement, subject to strict requirements<\/li>\n <li><strong>Limited risk:<\/strong> Systems with transparency obligations, such as chatbots<\/li>\n <li><strong>Minimal risk:<\/strong> Barely regulated applications such as spam filters<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What does the GDPR protect and who does it affect?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The GDPR protects the personal data of natural persons in the EU. It regulates how companies may collect, store, process and share data. Since 2018 it has applied to every organisation that processes data belonging to EU citizens \u2014 regardless of where the organisation is based.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The GDPR is built on the principles of data minimisation, purpose limitation and transparency. Data subjects have the right to access, rectification, erasure and objection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are the most important differences between the EU AI Act and the GDPR?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most important difference lies in what each framework protects: the GDPR protects personal data, while the EU AI Act protects against risks posed by AI systems. An AI system can fall under the EU AI Act without processing any personal data at all.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n <li><strong>Scope:<\/strong> The GDPR applies to any processing of personal data. The EU AI Act applies specifically to AI systems on the EU market.<\/li>\n <li><strong>Regulatory logic:<\/strong> The GDPR follows the principle of consent and purpose limitation. The EU AI Act follows a risk-class model with graduated obligations.<\/li>\n <li><strong>Addressees:<\/strong> The GDPR targets controllers and processors. The EU AI Act distinguishes between providers, operators, importers and distributors.<\/li>\n <li><strong>Penalties:<\/strong> GDPR infringements can be fined up to 4 % of global annual turnover. The EU AI Act provides for fines of up to \u20ac35 million or 7 % of turnover.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Where do the EU AI Act and the GDPR overlap?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Both frameworks overlap where AI systems process personal data \u2014 for example in recruiting tools, recommendation algorithms or automated decision-making systems. In these cases, companies must comply with both frameworks simultaneously.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One example: an AI system for credit scoring is classified as a high-risk system under the EU AI Act and is subject to strict transparency and oversight obligations. At the same time it processes personal financial data, triggering GDPR obligations \u2014 in particular the right to an explanation of automated decisions under Article 22 GDPR.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How do you prepare for both the EU AI Act and the GDPR at the same time?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The first step is an AI inventory: which AI systems are in use, and what data do they process?
