One of the central requirements is so-called human oversight of AI systems \u2014 a topic that concerns IT teams, compliance officers, and executives alike.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What does the law mean by human oversight of AI?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">According to the EU AI Act, human oversight of AI systems means that humans must be able to understand, monitor, intervene in, and if necessary stop the operation of an AI system. The law refers to this as &#8222;Human Oversight&#8220; and makes it a fundamental requirement for the lawful use of AI in certain areas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Human Oversight is an active process: it is not enough that someone could theoretically intervene. The system must be designed in such a way that supervisors can actually follow and evaluate results \u2014 AI decisions must be transparent, and blind trust in system outputs is not permitted.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Which AI systems are subject to the oversight obligation?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The oversight obligation applies primarily to high-risk AI systems \u2014 that is, systems used in sensitive areas such as human resources management, education, healthcare, law enforcement, or critical infrastructure. An AI system is classified as high-risk if it is used in one of the areas listed in Annex III of the EU AI Act and can have a significant impact on the rights or safety of people \u2014 for example in hiring decisions, credit assessments, or medical diagnoses.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What specific obligations does this create for companies?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Companies that deploy or develop high-risk AI systems must implement technical and organisational measures for human oversight. The most important obligations at a glance:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n <li>The AI system must be comprehensible to supervisors.<\/li>\n <li>There must be a way to stop the system or override its outputs.<\/li>\n <li>Supervisors must be identified and trained.<\/li>\n <li>Processes for the regular review of AI decisions must be documented.<\/li>\n <li>Operational logs of the system must be maintained.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What is the difference between operator and provider obligations?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The EU AI Act draws a clear distinction between providers (developers and marketers of an AI system) and operators (companies that deploy a system in their own context). Providers must ensure that their AI system is technically built in a way that makes human oversight possible: explainable outputs, a shutdown option, and sufficient documentation. Operators must designate and train suitable supervisors, deploy the system exclusively within the framework intended by the provider, and document any deviations and issues.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are the consequences of insufficient human control over AI?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Those who fail to meet the requirements risk severe penalties: for serious violations, the EU AI Act provides for fines of up to 30 million euros or six percent of global annual turnover.
